Judge Sets Hearing Date for 280 Elizabeth St. Project in Inman Park

Some Inman Park residents want judge to review approval process.

A Fulton County Superior Court judge has set a Dec. 18 hearing date at 9 a.m. for the controversial 280 Elizabeth St. project in Inman Park.

The $45 million mixed-use development calls for the construction of 204 rental units, a swimming pool, between 38,000 and 39,000 square feet of retail and a 570-space parking deck.

The Inman Park Neighborhood Association — following months of vigorous debate — voted to support the project in July. The Urban Design Commission gave its approval to the project in August.

But a core group of Inman Park residents filed an appeal in Fulton County Superior Court in September seeking a judicial review of the process by which one of the project's developers,  JPX Works LLC, received a number of variances.

The plaintiffs, Milner "Scott" Ball, Frank Schultz, Janet Grace and Marguerite Sweet, say the Atlanta Urban Design Commission acted beyond the scope of its discretionary powers, when it granted those variances.

"As aggrieved homeowners residing in the Inman Park Historic District, the appellants have the right to seek judicial review of the Atlanta Urban Design Commission’s approval of a certificate of appropriateness for variances in the Inman Park Historic District," the plaintiffs wrote in their filing.

The city, which is named in the appeal, along with JPX Works' attorney, have said they expect the Urban Design Commission's approvals to be upheld.
